Will of Martin Thomas, proved 25 July 1848

Deanery of Saint Buryan
The last Will and Testament of Martin Thomas late of the Parish of Saint
Buryan Yeoman deceased proved in Common form this 25th. Day of July 1848
(by certified Copy from the Registry of the Archdeaconry Court of
Cornwall) Before the Reverend George Henry Far Clerk Surrogate and
Administration of the Goods of the said deceased and of all things
whatsoever concerning his said Will was granted to Martin Thomas and
Edmund Thomas Yeomen the Executors named in the said Will
Savings &c.

This is the last Will and Testament of me Martin Thomas of Trevurguns in
the Parish of Saint Buryan in the County of Cornwall Yeoman. First I
give and Bequeath unto my Wife Elizabeth Thomas all my Stock Chattels
Goods and Household furmiture save and except a Mohogany Chest of
drawers during her life also all that Messuage and Tenement known by the
name of Douran in the Parish of Saint Just for her life also giving the
said Elizabeth Thomas power of drawing for her own use & maintenance if
required money from time to time out of any Cash that I may be left I
give and Bequeath unto my Sister Dorithy Thomas for her life an annuity
of six pounds per annum to be paid to her quarterly by my Executors out
of my Leasehold property at Saint Just in the event of the said Dorithy
Thomas outliving the Lease I then Will and direct my Executors to pay
her the said Annuity of six pounds out of my Cash that may be left or
placed in their hands I give and bequeath unto my Neice Mrs Henry Thomas
of Church town St. Buryan a Mohogany Chest of drawers I give and
bequeath unto Martin Bosusto of Penzance the sum of Nineteen Pounds Ten
Shillings to be paid to him by my Executor also I give and bequeath the
like sum of Nineteen Pounds and Ten Shillings unto James Bosusto the
younger of Castallack in the Parish of Paul I hereby appoint and
nominate the said Martin Thomas of Trevurgans and James Bosusto the
younger of Castallack in the parish of Paul to act and be as Trustees
and Guardians over my Wife Elizabeth Thomas nothing doubting but they
will do justice in the premises each being accountable to the other and
Both to her for their Conduct in her affairs Lastly I give and bequeath
after the decease of my Wife the said Elizabeth Thomas not my two
Nephews Martin Thomas and Edward Thomas absolutely my leasehold property
known by the name of Douran Situated in the Parish of Saint Just also
all stock Crops Chattels goods furniture monies securities for monies to
her divided equally between them my two Nephews to share and share alike
I do hereby nominate Constitute and appoint them my said Nephews Martin
Thomas and Edward Thomas as Executors of this my last Will and Testament
and I further direct that my said Executors shall in carrying into
effect the Trusts of this my Will first pay all my just debts funeral
and Testamentary expences and shall be at liberty to

deduct retain pay reimburse and satisfy themselves any Costs charges and
expences that they may incur in and about the execution and performances
of the Trusts of this my Will or in any wise relating thereto and that
they my Executors shall only be answerable and responsible for any
wilful and negligins default in not carrying into Effect the Trusts of
their Executorship and lastly I hereby revoke and make void all and
every other Wills and Will by me at any times or time heretofore made In
Witness whereof I the said Martin Thomas (the Testator) have hereunto
subscribed and set my hand this twenty sixth day of November in the year
of our Lord 1847

Testament of Martin Thomas late of the Parish of Saint Buryan Yeoman
