Will of John Rogers, proved 1 April 1850

Deanery of St. Buryan
The last Will and Testament of John Rogers the younger late of the
Parish of St. Buryan Mason deceased proved this first day of April 1850
in common form before the Reverend George Henry Farr Clerk Surrogate and
Administration of the Goods of the said Deceased and of all things
whatsoever concerning his said Will was granted to Eliza Rogers widow a
Legatee and Trustee of the said Will until George the youngest child of
the said Deceased now of the age at about four years should attain his
age of 21 years provide the said Eliza Rogers should so long remain a
Widower. Saving the right of the children of the said Deceased when they
should have severally attained their respective ages of 21 Years and
also saving the right of all other persons.

This is the Last Will and Testament of me John Rogers Junr of The Crean
within the parish of St. Buryan in the County of Cornwall, Mason. First
I desire my legal debts to be paid and then to Divide the property in
the following manner consisting of first my half of all those four free
Houses Garden fish Cellars and appurtenances hereunto belonging situated
at Mousehole in the parish of Paul Secondly my half of all that free
Farm called Chynance situate in the parish of St Buryan Thirdly my half
of all that Dwelling house Garden and premises situate at Treen in the
parish of St Levan Fourthly my two thirds of all that lease Farm and
premises also situate at Treen in the parish of St Levan called and
Known by the name of Carrows Tennement I hereby Give and bequeath the
aforesaid property to my Wife Eliza Rogers my two sons John and George
Rogers and my two Daughters Hannah and Amelia Rogers in the following
proportions My two Sons to have two shares to the Girls one and if
either of them should Die before the age of twentyone Years his or her
part to be Divided amongst the survivors as before, two shares to the
sons same to the Daughters Their Mother my Wife Eliza Rogers to pay
receive manage and contract all the affairs of the fammily and property
til the youngest Child come of the age of Twenty one Years I also give
her the power to sell all and every part of the of all the houses Garden
and premises belonging at Mousehole in the parish of Paul after the
youngest Child arrive at the age of twenty one years they are to pay to
my Wife Eliza Rogers the following annuity my two Sons John and George
Rogers each to pay her the sum of five Pounds per Year and my Two
Daughters Hannah and Amelia Rogers to pay yearly each of them two Pounds
ten Shillings and if either of them should

Die the part of the required annuity must be paid out of his or her
property. I Also Give unto my Wife al the household Furniture of every
description, in no Case to borrow Money on any part of the Property. But
if she should be married again She is to Loose all Authority power and
all Claim to any and every part of the Property Whatsoever.
In Witness whereof I have to this my Last Will and Testament set my hand
and Affixed my Seal this Nineteenth Day of October one thousand eight
hundred and forty nine

Special Affidavit of John Wallis Elizabeth Ellis and Grace Tregurtha the
subscribed Witnesses to the Will of John Rogers the Younger late of the
Parish of Saint Buryan, Mason Deceased as to the due Execution of the
same Will.

In the Goods a/c of John Rogers the younger late of the Parish of Saint
Buryan in the County of Cornwall Mason Deceased
Appearing personally John Wallis Farmer and Elizabeth Ellis and Grace
Tregurtha Spinsters all of the said Parish of Saint Buryan and severally
made oath that they are the subscribed witnesses viz “John Wallis
Elizabeth Ellis and Grace Tregurtha” to the last Will and Testament of
John Rogers the younger late of the said Parish of Saint Buryan Mason
deceased now hereunto annexed the said Will commencing thus "This is the
last Will and Testament of me John Rogers Jnr of the Crean within the
Parish of St. Buryan in the County of Cornwall Mason" and ending "In
Witness whereof I have to this my last Will and Testament set my hand
and affixed my Seal this nineteenth day of October one Thousand Eight
hundred and forty nine John Rogers " and these Deponents further
severally say that they were all severally present at the same time when
the said Deceased on the said nineteenth day of October last subscribed
his name at the foot or end of the said Will and that the name "John
Rogers" so subscribed is of the proper handwriting of the said John
Rogers the younger and that these Deponents thereupon in the presence of
the Testator and of each other subscribed their names as Witnesses to
the said Will
