Will of James Richards, proved 22 June 1846

Deanery of Saint Buryan.
The last Will and Testament of James Richards late of the Parish of
Saint Buryan Carpenter deceased proved in Common form the 22nd. day of
June 1846 Before the Reverend William Mountford Stacey, Clerk Surrogate
and Administration of the Goods of the said Deceased and of all things
whatsoever concerning his said Will was granted to James Thomas Richards
George Richards John Richards Richard Richards and Joseph Richards all
of the said parish of Saint Buryan Carpenters Sons of the said deceased
and Johanna Richards Widow the Ezecutrix and Executors named in the said
Will.

This is the last Will and Testament, of me James Richards of the Church
Town of the parish of Saint Buryan in the County of Cornwall Carpenter -
I Give and bequeath unto my dear wife Johanna Richards All that my
Leasehold Dwelling House and premises wherein I now reside situate in
the said Church Town of Saint Buryan To Have and to Hold the same unto
my said wife for all such term Estate and Interest as may be therein to
come and expire at the time of my death but never the less it is my will
that the same Dwelling House and premises shall be considered and taken
to be a home for the whole of my Family.
I also Give and bequeath unto my said wife all my Household Goods and
Furniture for the use of her and all my children hereinafter named
during her life and after her decease I Give and bequeath the same
Household Goods and Furniture unto and amongst my five Sons hereinafter
named share and share alike
I Give Devise and bequeath unto my said Wife Johanna Richards one
annuity or clear yearly rent charge or sum of Twenty pounds to be
issuing and payable to her by quarterly payments out of the property and
affects hereinafter Given Devised and bequeathed to my five Sons
hereinafter named and which annuity of Twenty Pounds shall be paid and
apportioned in the manner herein after mentioned that is to say the Sum
of Five Pounds by my Son James Thomas Richards and the sum of Three
Pounds and fifteen shillings by each of my four Sons George Richards
John Richards Richard Richards and Joseph Richards making altogether the
said Sum of Twenty Pounds the first quarterly payment of the said
annuity to become due and be paid in such of the usual quarterly days of
payment of rent as shall next happen after my death and I subject and
make liable the whole of the property and effects hereinafter Given and
Devised and bequeathed to my five Sons with the payment thereof in the
several and respective portions as aforesaid.
I give and Devise unto my said Son James Thomas Richards All that my
Freehold Messuage Tenement and premises called Chivarton situate in the
said Parish of Saint Buryan now in the occupation of Charles Ellis To
Have and to Hold the same unto my said Son James Thomas Richards his
Heirs and assigns for ever subject to the payment of the said sum of
Five Pounds annually in part discharge of the said annuity of Twenty
Pounds to my said wife and also subject to the payment of the sum of
Sixty Pounds being one fifth part of the sum of Three Hundred Pounds
hereinafter bequeathed to my three Daughters
I give and Devise unto my said Son Richard Richards All those my three
Freehold Messuages or Dwelling Houses Garden

and premises situate in the said Church Town of Saint Buryan now in the
Several occupation of James Carne John Hutchens and Mary Boase part of
one of which Dwelling Houses is now unoccupied and also all that my
Freehold Meadow also situate in the said Church Town of Saint Buryan now
in my own occupation and also all those my two Freehold messuages or
Dwelling Houses and premises situate in the Village of Mousehole in the
Parish of Paul in the said County of Cornwall now in the several
occupation of Joseph Hocking and Richard Quick To Have and To Hold the
said several premises in the said Church Town of Saint Buryan and
Village of Mousehole aforesaid unto my said Son Richard Richards his
Heirs and assigns for ever subject to the payment of the said Sum of
Three Pounds and fifteen Shillings in part discharge of the said annuity
of Twenty Pounds to my said wife and also Subject to the payment of the
Sum of Sixty Pounds being one firth part of the Sum of Three Hundred
Pounds hereinafter bequeathed to my three Daughters.
I also give and bequeath unto my said Son Richard Richards all that my
Leasehold messuage or Dwelling House Garden Blacksmith Shop and premises
situate in the said Village of Mousehole now in the occupation of
William Williams and also all that my Leasehold messuage or Dwelling
House Orchard and Garden situate near Barnewhall reage and part of the
Tenement of Trevervin in the said Parish of Saint Buryan now in the
occupation of John Stevens To Have and To Hold the same Several and
respective Leasehold premises unto my said Son Richard Richards his
Executors administrators and assigns for all such term and Teney Estate
and interest as may be therein respectively to come and expire at the
time of my death.
I give and Devise unto my Son Joseph Richards all that my Freehold
messuage Tenement and Premises situate in Trevorrian Vean in the said
Parish of Saint Buryan now in the occupation of John Short To Have and
To Hold the same unto my said Son Joseph Richards his Heirs and assigns
for ever subject to the payment of the said Sum of Three pounds and
fifteen Shillings in part discharge of the said Annuity of Twenty Pounds
to my said wife and also Subject to the payment of the sum of Sixty
Pounds being one fifth part of the sum of Three Hundred Pounds
hereinafter bequeathed to my three Daughters.
I also give and bequeath unto my said Son Joseph Richards all that my
Leasehold messuage or Dwelling House Garden

and premises situate in the Green in the said Church Town of Saint
Buryan now in the occupation of Daniel Waters To Have and to Hold the
same unto my said Son Joseph Richards his Executors Administrators and
assigns for all such term Estate and Interest as may be therein to come
and expire at the time of my death.
I Give and bequeath unto my said Son George Richards the sum of Three
Hundred and twenty five Pounds Sterling to be paid to him three months
after my decease Subject to the payment of the said Sum of Three Pounds
and fifteen shillings in part discharge of the said annuity of Twenty
Pounds to my said wife and also Subject to the payment of the Sum of
Sixty Pounds being one fifth part of the sum of Three Hundred Pounds
hereinafter bequeathed to my three Daughters.
I Give and bequeath unto my said Son John Richards the sum of Three
Hundred and twenty five Pounds Sterling to be paid to him three months
after my decease subject to the payment of the said sum of Three Pounds
and fifteen Shillings in part discharge of the said annuity of Twenty
Pounds to my said wife and also Subject to the payment of the sum of
Sixty Pounds being one fifth part of the sum of Three Hundred Pounds
hereinafter bequeathed to my three Daughters.
I Give and bequeath unto my Daughter Selina Richards All that my
leasehold messuages Dwelling House Garden and premises situate in the
Green in the Church Town of Saint Buryan aforesaid now in the occupation
of James Ladner To Have and to Hold the same unto my said Daughter
Selina Richards her Executors administrators and assigns for all such
term Estate and interest as may be therin to come and espirce at the
time of my death.
I Give and bequeath unto my daughter Johanna Richards All that my other
leasehold messuage or Dwelling House Garden and premises situate in the
Green in the Church Town of Saint Buryan aforesaid now in the occupation
of James Oliver To Have and to Hold the same unto my Said Daughter
Johanna Richards her Executors Administrators and assigns for all such
Term Estate and interest as may be therein to come and expire at the
time of my death.
I Give and bequeath unto my Daughter Jane Jacka Richards all that my
other leasehold messuage or Dwelling House Garden and premises situate
in the Green in the Church Town of Saint Buryan aforesaid now in the
occupation of George Matthews To Have and to Hold the same unto my said
Daughter Jane Jacka Richards her Executors Administrators and assigns
for all such term Estate and interest as may be therein to come and
expire at the time of my death.
I Give and bequeath unto my said Daughter Selina Richards the Sum of One
Hundred Pounds Sterling.
I Give and bequeath unto my said Daughter Johanna Richards the Sum of
One Hundred Pounds Sterling.
I Give and bequeath unto my said Daughter Jane Jacka Richards the

Sum of One Hundred Pounds Sterling which said three several Sums of One
Hundred Pounds I direct to be paid by my said five Sons at the time of
my said Daughter Jane Jacka Richards attaining the age of twenty one
years Provided always and it is my will and intention that the said
Legacies of Three Hundred and Twenty five Pounds and Three Hundred and
twenty five Pounds hereinbefore bequeathed and the Shares of residue
hereinafter bequeathed to or in favour of my said Sons George Richards
and John Richards respectively are and is not to be deemed and
considered or in any way taken as an intention on my part to discharge
my said Sons George Richards and John Richards or either of them from
the payment of any Sum or Sums of money which may be due and owing from
them or either of them to me at the time of my decease.
All the rest residue and remainder of my Goods Chattels money Securities
for money Stock in Trade Book Debts rights credits and Effects
whatsoever that I shall die possessed of or entitled unto I do hereby
give and bequeath unto my said five Sons share and share alike and I do
hereby nominate constitute and appoint my said wife and my said five
Sons Executrix and Executors of this my last Will and Testament hereby
revoking all former and other Will and Wills by me at any time
heretofore made In witness whereof I have to this my Will contained in
four sheets of paper set my hand to each Sheet thereof this twentyfifth
day of July in the year of our Lord one thousand eight hundred and forty
five - (1845)
