Will of James Permewan, proved 3 January 1843

The last Will and Testament and Codicil thereto, of James Permewan late
of the Parish of St.Buryan Gentleman deceased proved in Common form
before the Rev.Charles Jenkyn Surrogate.
And Administration of the Goods of the said deceased and of all things
whatsoever concerning his said Will was granted to James Permewan and
John Permewan the Sons of the deceased and Executors named in his said
Will.

This is the last Will and Testament of me James Permewan of Tregadgwith
in the Parish of Saint Buryan in the County of Cornwall gentleman
I give and bequeath one Annuity or clear yearly sum of Fifty five pounds
to my dear wife Charity to be paid to her quarterly during her life
provided she shall so long continue my Widow and no longer - and I give
the said Annuity of Fiftym five pounds to my said wife in addition to
the Annuity of Forty five pounds settled on her under the Settlement
made on our marriage and which I confirm in all respects it being my
will that my said wife shall after my death have and enjoy the full sum
of One hundred a year during her widowhood and which the Annuity already
settled and that which I have now given her will amount to.
I give and bequeath all my Household goods and furniture Plate Linen and
China to my said wife for life provided she shall so long continue my
widow and on her death or second marriage I give the same to my Two
daughters Jane and Grace if they shall be both single or to such of them
as shall be then unmarried to be held by them whilst they or she shall
continue single and after one of them shall die or marry (which ever
shall first happen) then I give the same absolutely to my said daughter
who shall survive or shall last remain single.
I give and bequeath an Annuity of clear Annual sum of Twenty five pounds
a piece to each of my said daughters Jane and Grace and which shall be
paid to them respectively by my Executors hereafter named during my said
wifes life time or whilst she continues my widow and which said
Annuities shall be paid to my said daughters respectively for such time
only as they shall both live and remain single and unmarried but on the
second marriage or death of my said wife I give to my said two daughters
in lieu and stead of the said Annuities of Twenty five pounds the
several Annuities of Fifty

Pounds a year each to be paid and payable to each of them whilst they my
said daughters shall both live and shall both continue to remain single
and unmarried. And on the Marriage or death of either of my said
daughters I direct the said Annuities of Twenty five Pounds or fifty
Pounds which ever it may then be to cease and be no longer payable and I
give to such or both of my said daughters as shall marry and on the day
of her or their marriage the sum of Five Hundred Pounds a piece to be
paid to them or their assigns by the Executors herein after named. And
on the marriage or death of either of my said daughters then these said
Annuities or either of them will no longer be payable and in such case I
give and bequeath to my said daughter after he Sisters death or marriage
one Annuity or clear Annual sum of Seventy five pounds to be paid to her
quarterly during such time as she shall remain single and unmarried. And
I direct that the said several Annuities or Annual rent charges shall be
payable by quarterly payments out of my freehold Estate of Bosanketh and
Trelew in the said Parish of Saint Buryan and I give the several
Annuitants full and complete powers of distress and entry on both or
either of my said Estates to recover the same in case they or any of
them or any part thereof shall be in arrear or unpaid and I further
direct that every Annuity so given by this my Will shall commence and
begin from the day of my decease and be Increased as I have directed
from the day of the occurence happening on which I have made the same to
arise and become payable - and I hereby in like

manner charge and make subject and liable all my said Freehold Estate of
Bosanketh and Trelew with and to the payment of the sum of Five Hundred
Pounds to each of my said Daughters on their respective marriages
Whereas I am now about to erect and finish a Dwelling house at the
Church Town of Saint Buryan on a certain Leasehold premises there which
I hold under Mr. Richard Hodge now I hereby direct my Executors
hereafter named to complete and finish the same House immediately after
my death at the expence of my Estate in out of what they shall take
under the disposition of this my Will and after the same shall be so
complete and finished I give and bequeath the same Dwelling house to my
wife for her life if she shall so long continue my Widow and on her
death or Second Marriage I give the same to my two daughters whilst they
shall both continue single and on the marriage or deaths of either I
give the same to my daughter last continuing single during the time she
shall continue single and after the death or marriages of my said
daughters or their Mother then I direct that the said House shall fall
into the Residue of my Estate and Effects. And I direct that the party
or parties who shall tend to this my Will be entitled to occupy the said
Dwelling House shall and do keep and continue the same in fair
tenantable repair and condition -
All the Rest residue and remaining of my Estate and Effects of what
nature or kind soever or wheresoever situate and being both real and
personal subject and chargeable with and to the

payment of my just Debts and funeral and Testamentary Expenses I give
devise and bequeath the same and every part thereof to my two Sons James
Permewan the Younger and John Permewan to hold the same to them my said
Sons in Equal Moieties or half parts share and share alike and to their
several and respective Heirs Executors Administrators and Assigns
absolutely and for ever as Tenants in Common and not as joint Tenants
and I hereby appoint the said James Permewan the Younger and John
Permewan to be the Residuary Legatees and Devisees and Executors of this
my Will hereby revoking all former Wills by me made.
In Witness whereof I the said Testator James Permewan have to this my
last Will and Testament set my hand this Seventh day of June One
Thousand Eight Hundred and Forty Two. 1842

Testament the in the presence of us present at the same time who in his
presence and in the presence of each other have hereunto subscribed our
names as attesting Witnesses.

This is a Codicil to the last Will and Testament of me James Permewan of
Tregadgwith in the parish of Saint Buryan in the County of Cornwall,
Gentleman, and which I direct shall be taken as a part and parcel of my
Will.
Whereas I have by my said Will given an Annuity of Seventy five pounds a
year to arise on either of my daughters dying or marrying, to the
daughter who shall remain and continue single and to be paid to the said
daughter during the time she shall to continue single - Now I do hereby
direct that the said Annuity of Seventy five pounds shall not arise or
be paid to such unmarried daughter until the death or second marriage of
my Wife Charity. And that during the life or widowhood of my said wife,
and after the death or marriage of such of my daughters who shall first
die or marry in such case, and until the said Annuity of Seventy five
pounds shall become payable - My daughter remaining single after her
Sisters death or marriage shall and do take up and receive in like
manner, and out of the same Estates as she would have taken her said
Annuity of Seventy five pounds one clear Annuity or Annual sum of Fifty
- pounds only the same to paid to her and her Assigns by quarterly
payments during her Mothers widowhood if she my said daughter shall so
long continue single - And upon her Mothers death or second marriage
then the said Annuity of Fifty - pounds shall cease - And the said
Annuity of Seventy five pounds shall arise and become payable under the
directions

and provisions of my said, Will. In Witness whereof I the said Testator
James Permewan have to this my Codicil set my hand this Tenth day of
June one thousand eight hundred and forty two.
