Will of Thomas Osborn, proved 24 August 1826

24th. Augt. 1826
The last Will & Testament of Thomas Osborn late of the Parish of Burian
Farmer deceased proved in common form before the Revd Uriah Tonkin,
Surrogate -
And Admon of the Goods & etc. of the said deceased, and of all things
whatsoever concerning his said Will was granted to John Osborn and
Charles Osborn two of the Sons of the said deceased and the Executors
named in his said Will.

In the name of God Amen.
This is the last Will and Testament of me Thomas Osborn of the Parish of
Saint Buryan in the County of Cornwall Farmer.
First. I order and direct that All my just Debts and funeral expences,
be paid and discharged by my Executors hereinafter named as soon as
conveniently may be after my death save and except the Debts hereinafter
mentioned and charged on my Heriditaments and Premises in Rosepletha.
Also. I give and bequeath unto my dear wife, Sarah Osborn, during her
natural life, in addition to the annuity of Seven pounds per annum
served to her previously to our Marriage, one annuity rent charge or sum
of Three Pounds as in all Ten pounds per annum to be paid and payable to
her or her assigns by quarterly payments from my death.
Also. I give and bequeath unto my said Wife Two Beds and Bedding and
such other Articles of Household Furniture, as she may select and choose
for her use during her life.
Also. I give and bequeath unto my second Son, Thomas Osborn, during his
natural life one annuity Rent charge or Sum of Five Pounds per annum to
be paid and payable to him or his assigns by quarterly payments from my
death.
Also. I give and bequeath unto my said son Thomas, from and after the
death of my said Wife, a further annuity rent charge or sum of Five
pounds per annum to be paid and payable to him or his assigns, by
quarterly payment from and after the death of my said Wife thenceforth
during his natural life.

Also. I give and bequeath unto each of my Sons, John Osborn and Charles
Osborne, from and after the death of my said Wife, an Annuity rent
charge or sum of Five pounds per annum apiece to be paid and payable to
each of them respectively, or his assigns, from and after the death of
my said Wife by quarterly payments thenceforth during their respective
natural lives.
Also. I order and direct that the said several annuities to my said Wife
and Sons shall be paid to her and them clear of all outgoings and
deductions whatsoever And I do hereby charge and make subject and liable
my Freehold and Leasehold Messuage Tenement and Premises, in or called
Rosepletha in the Parish of Saint Levan in the said County, with and to
the payment of the said Several Annuities and each of them: And in case
of nonpayment of them, or either of them or any part thereof, in manner
aforesaid, I do hereby give my said Wife and Sons, respectively, power
of distress and entry on my said Messuage Tenement and premises for
payment and recovery thereof, and of the Costs attending the serving
thereof, the same as in ordinary Cases of distress and entry on
nonpayment of rent,
Also. All my said Freehold and Leasehold Messuage Tenement Hereditaments
and premises in _ Rosepletha aforesaid Subject to the payment of the
said Several Annuities and also subject to the payment of the several
Sums of One Hundred and Six pounds and Fifty pounds and ten

shillings due from me to Rebecca Badcock and my Brother, Martin Osborn,
on two several Promissary notes of hand - but not the Interest which may
be due thereon at the time of my death - which I do hereby charge on my
said Heriditaments and premises. I do hereby give devise and bequeath
the same and every part thereof unto my Eldest Son William Osborn, To
Hold to him his Heirs, Executors, Administrators and Assigns,
respectively, from and after my death thenceforth absolutely and for
ever provided always that if I should happen to die between this time
and Michaelmas next, my son Thomas is not to be charged any Rent for the
said premises prior to that period except his and his mother’s annuities
and do hereby exonerate him from the payment of any Rent which may be
due from him to me up to the time of my death
Also I give and bequeath unto my said Son John Osborne the sum of Fifty
pounds to be paid to him Six Months after my decease.
Lastly All the rest residue and remainder of my Property and Effects I
give and bequeath unto my said two sons John and Charles, and To Hold
the same unto them, in equal shares and proportions, share and share
alike as Tenants in Common and not as Joint Tenants and to their Several
and respective Executors Administrators and assigns from my death
thenceforth absolutely and for ever. And I do hereby make nominate and
appoint my said Sons John and Charles whole and sole Executors of this
my Will hereby revoking all former Wills by me made and declaring this
only to be my last Will and Testament. In witness whereof I have
hereunto set my hand and Seal the tenth day of June in the year of our
Lord one thousand eight hundred and twenty six. 1826.
