The last Will & Testament of Jane Hodge late of the Parish of St. Burian Spinster deceased proved in common form before the Revd. U. Tonkin Surrogate -
And Admon of the Goods &c of the said deceased & of all &c granted to Wm. Osborne one of the Exors. in Trust named in said Will the other Exor. having renounced

This is the Last Will and Testament of me Jane Hodge Spinster of the Parish of St Buryan in the County of Cornwall.
 
I Give devise and bequeath unto my Sister Mary Hodge for her life One Annuity of Five Pounds per Annum and her receipt alone on payment of the same from time to time to be considered a sufficient discharge.
 
Also I Give devise and bequeath unto my First cousin William Cargenvan James for his life one Annuity of One Pound per Annum and his receipt alone on payment of the same from time to time to be considered a sufficient discharge.
 
Also I Give devise and bequeath unto my niece Sarah Ellis Osborn (so long as her father William Osborn shall live) one Annuity of Five Pounds per Annum the first payment to commence and be made as soon as she shall attain the full age of twenty one years And three calendar months after the death of her said Father William Osborn. The aforesaid Annuity of Five Pounds per Annum shall cease. And then I Give devise and bequeath unto my said niece Sarah Ellis Osborn the sum of One hundred Pounds of Lawful English money. Which said sum of one hundred Pounds shall be paid her by the Executors Administrators or Assigns of her said Father William Osborn.
 
The aforesaid several annuities to be issuing and payable out of the Interest of my moneys which I have now to Interest or out of any part or parts thereof the same to be paid in yearly payments the first of the said payments to commence and be made twelve months next after my decease
 
All the rest residue and remainder of my Estate Goods Chattles and Effects Whatsoever and wheresoever and of what nature and kind soever as well Real as personal not herein before by me given devised or bequeathed I do hereby Give Devise and bequeath unto my nieces Elizabeth Hodge Osborn, Anne Hodge Osborn and Mary Osborn to be equally divided between them or the survivors or survivor of them as soon as they shall severally attain the full age of twenty one years. And I do hereby make nominate and appoint my Brother in Law William Osborn and Mr. Richard Dennis of Trembath in Madron to be Executors in trust of this my last Will and Testament to and for the only use benefit and advantage of my said nieces and legatees during the minority of my aforesaid nieces, and my will and meaning is that my said Executors in trust shall and may Receive all Interests of moneys or money of Interest and pay the aforesaid annuities therewith and Lend money to Interest as they shall or may think proper for the benefit of the said Legatees. And I do likewise impower my said Executors and Trustees and the survivor of them to deduct and retain all such costs charges and expences as they or either of them may be at in the Execution of this my Will or the Trusts hereby in them reposed and I hereby all former and other Will or Wills by me at any time heretofore made and declare this and no nother to be my Last Will and Testament. In witness whereof I the said Jane Hodge the Testatrix have to this my Last Will set my name and affixed my Seal this the nineteenth day of January in the year of our Lord one thousand eight hundred and twenty seven.

I the undersigned Richard Hodge do acknowledge to have this day renounced Probate of the Will of Jane Hodge late of the Parish of Saint Buryan within the said Deanery Spinster deceased to William Osborn said Co Executor in Trust in the said Will named and hereby undertake and assure to execute any formal Instrument or Stamp that may hereafter be required of me by my said Co Executor or the Registrar of the Court for that purpose the same being prepared at the expence of my said Co Executor and I the undersigned William Osborn Co Executor of the said Richard Dennis in the said Will named to hereby undertake to hear and pay the expence of such formal Renunciation when called on for the same
