The last Will and Testament of Robert Harvey late of the Parish of Saint
Buryan Farmer deceased proved in Common form before the Reverend John
Tonkin Surrogate.
And Administration of the Goods &c of the said Deceased and of all &c
granted to Elizabeth Harvey Widow and the Sole Executrix named in his
said Will.

The Will of Mr. Robert Harvey of St. Buryan.

This is the last Will and Testament of me Robert Harvey of the parish of
Saint Buryan in the County of Cornwall Farmer.
I give and devise unto my dear wife Elizabeth Harvey and to my nine
children Elizabeth Harvey, John Harvey, James Harvey, Edwin Harvey,
William Harvey, Richard Harvey, Mary Harvey, Charles Harvey and Anne
Harvey All these my Freehold Messuages Lands Tenements Hereditaments and
premises situate in and parts and parcels of Trove otherwise Trewoofe,
in the said parish of Saint Buryan To hold the same with the rights
members and appurtenances thereinto belonging, unto my said wife and
nine children their several and respective Heirs and assigns for ever,
in equal tenth parts of shares as Tenants in Common and not as joint
Tenants, subject nevertheless to the provisions hereinafter contained.
And also Subject (together with my personal Estate and effects) to the
payment of my just debts, Provided always nevertheless that if any or
either of my said nine children shall happen to die before he she or
they shall attain the age of twentyone years, that then the part or
share or parts or shares of him her or them so dying shall go to and I
hereby give and devise the same unto and amongst the survivors of them
my said nine children and my said wife, their several and respective
Heirs and assigns for ever, share and share alike as Tenants in Common;
Provided also that in case of my said wife shall continue my widow but
not otherwise, she shall have the entire control management and disposal
of the rents incomes and profits of the parts or shares of all my said
children in the said Hereditaments and promised, until the youngest of
such of my said children as shall survive shall attain the age of
Fourteen years.
I give and bequeath unto my said wife Elizabeth Harvey and my said nine
children, all my Household Goods and Furniture, Farm Stock, Husbandry
Implements, money securities for money and all other my Goods Chattels
rights credits and effects whatsoever and wheresoever that I shall die
in possession of or entitled unto or over which I have a disposing power
or control, To hold the same and every of them unto my said wife and
nine children in equal tenth parts or shares, subject nevertheless
(together with my said Freehold Hereditaments and premises) to the
payment of my just debts and also subject to my Funeral expenses and the
charges of proving this my Will, And also subject to the proviso
hereinafter contained (that is to say) Provided always that in case my
said wife shall continue my widow, but not otherwise, she shall have the
entire control management and disposal of the parts or shares of all my
said children in my said personal Estate and Effects, until the youngest
of

Fourteen years, and I hereby nominate constitute and appoint my said
Wife sole Executrix of this my last Will and Testament, hereby revoking
all former and other Will and Wills by me at my time heretofore made, In
Witness whereof I the said Robert Harvey the Testator have to this my
Will contained in two sheets of paper, to the first sheet thereof set my
hand, and to this second sheet, set my hand and seal, this ninth day of
August in the year of our Lord on thousand eight hundred and fifty
(1850).

Signed sealed published and declared by the said
Robert Harvey the Testator as and for his last Will and Testament in
presence of us present at the same time, who at his request in his
presence and in the presence of each other have subscribed our names as
witnesses thereto.
