To the Churchwardens and Overseers of the Poor of the Parish of Saint Clement in the County of Cornwall, and to the Churchwardens and Overseers of the Poor of the Parish of Budock in the said County and to each and every of them.

To Wit

Upon the Complaint of the Churchwardens and Overseers of the Poor of the Parish of Saint Clement aforesaid in the said County of Cornwall unto us whose Names are hereunto set and Seals affixed being Two of Her Majesty’s Justices of the Peace, in and for the said County of Cornwall and one of us of the Quorum that JAMES BARTLE MARY his wife and seven children James aged about twenty one Elizabeth aged about 18 Mary Anne aged about 17 Thomas aged about 13 John aged about 11 Eliza aged about three and William aged about ten months have come to inhabit the said Parish of Saint Clement not having gained a legal settlement there nor produced any Certificate owning them to be settled elsewhere and that the said JAMES BARTLE MARY his wife, JAMES, ELIZABETH, MARY ANNE, THOMAS, ELIZA and WILLIAM their children are ACTUALLY CHARGEABLE TO THE SAID Parish of Saint Clement We the said Justices upon due proof made thereof as well as upon Examination of the said JAMES BARTLE upon oath as otherwise upon due consideration had of the Premises do adjudge the same to be true and we do likewise adjudge that the lawful Settlement of the said JAMES BARTLE MARY his wife, JAMES, ELIZABETH, MARY ANNE, THOMAS, ELIZA and WILLIAM THEIR Children is in the said Parish of Budock in the said County

We do therefore require you the Churchwardens and Overseers of the said Parish of Saint Clement or some or one of you to convey the said JAMES BARTLE MARY his wife JAMES, ELIZABETH, MARY ANNE, THOMAS, ELIZA and WILLIAM their children from and out of the said Parish of Saint Clement to the said Parish of Budock and them to deliver to the Churchwardens and Overseers of the Poor there or to some or one of them together with this our Order or a true Copy thereof at the same time shewing to them the original and we do also hereby require you the said Churchwardens and Overseers of the Poor of the said Parish of Budock to receive and provide for them according to Law.

Given under our Hands and Seals this Twenty third day of June in the Year of our Lord One Thousand Eight Hundred and Forty two.

Whereas it duly appears to us the above mentioned Justices of the Peace that JAMES BARTLE one of the Paupers above mentioned is unable to travel by reason of illness we do therefore in pursuance of the Statute in such Case made hereby suspend the execution of the within order until the same can be safely executed without danger to the said JAMES BARTLE.

The examination of HENRY CADDY now residing in the parish of Saint Clement in the said County of Cornwall, touching the place of the last legal settlement of MARY BARTLE Widow of JAMES BARTLE and JOHN, ELIZA and WILLIAM her Children taken on oath before us EDWARD COLLIN and HENRY PRYNN ANDREW two of her Majesty’s Justices of the Peace in and for the said County one whereof is of the Quorum at the Borough of Truro In the said County this eighteenth day of March 1847 upon complaint of the Churchwardens and Overseers of the Poor of the parish of Saint Clement in the said County, unto us the said Justices that the said MARY BARTLE having been a widow for more than twelve calendar months and JOHN, ELIZA and WILLIAM her said children have come to inhabit and are now inhabiting in the said parish of Saint Clement not having resided in the said parish for five years next before the said application and complaint and not having gained a settlement therein nor having produced any certificate acknowledging them to be settled elsewhere and that the said MARY BARTLE and JOHN, ELIZA and WILLIAM her said children are now actually chargeable to the said parish of Saint Clement but not having become chargeable in respect of relief made necessary by sickness or accident.

Who Saith that he is Assistant Overseer of the parish of Saint Clement in the County of Cornwall and as such has the custody of the parish papers of that parish this deponent produces from the parish chest of Saint Clement aforesaid an order of Removal dated the twenty third day of June One thousand eight hundred and forty two under the hands and seals of HENRY PRYNN ANDREW and GEORGE WIGHTMAN Esquire then and now two of his Majesty’s Justices of the Peace acting in and for the said County of Cornwall by which JAMES BARTLE the deceased husband of MARY BARTLE the pauper now present and their seven children herein named are directed to be removed from the parish of Saint Clement aforesaid to the parish of Budock in the said County that the said order was duly suspended on the day of the date thereof as appears at the foot thereof and that the same was afterwards directed to be executed as appears by the order endorsed thereon and under the hands and seals of the said GEORGE WIGHTMAN and of WILLIAM PETER KEMPE Esquire then and now a Justice of the Peace acting in and for the said County that a true copy of the said original order and of the order of suspension and of the order for execution of the same is hereunto annexed and marked A and that the several signatures “H.P. ANDREW” “G. WIGHTMAN” and “WILLIAM P. KEMPE” at the foot of the said several orders are of the respective proper handwritings of the said HENRY PRYNN ANDREW, GEORGE WIGHTMAN and WILLIAM PETER KEMPE deponent being well acquainted with their respective handwritings from having seen them all write that within a month next after the first day of December One thousand eight hundred and forty two Deponent put the said order of Removal in force by removing the said JAMES BARTLE and the said MARY BARTLE the pauper now present and their said three children JOHN ELIZA and WILLIAM from the said parish of Saint Clement to the said parish of Budock and by delivering them to the overseers of Budock at Budock aforesaid by virtue thereof and at the same time duly serving the said Order of Removal on the said Overseers of Budock and that the same was not appealed against.

To Wit

The complaint of HENRY CADDY one of the Overseers of the Poor of the Parish of Saint Clement in the said County of Cornwall, made on behalf of the Churchwardens and Overseers of the Poor, of the said Parish of Saint Clement and with their assent unto us the undersigned EDWARD COLLINS and HENRY PRYNN ANDREW two of her Majesty’s Justices of the Peace, in and for the said County, one whereof is of the Quorum, at the Borough of Truro in the said County this Eighteenth day of March in the year of our Lord 1847.

Who Saith that MARY BARTLE widow of JAMES BARTLE and her three children JOHN, ELIZA and WILLIAM the said MARY BARTLE having been a widow for more than twelve calendar months have lately come to inhabit and are inhabiting in the said Parish of Saint Clement endeavouring to settle there contrary to Law, not having resided in the said parish for five years next before this application and complaint, and not having gained a legal settlement there, nor having produced any Certificate acknowledging them to be settled elsewhere, and that about four? weeks since the said MARY BARTLE and JOHN, ELIZA and WILLIAM her said children became chargeable to and from thence hitherto have been relieved by and are now receiving relief from the said Parish of Saint Clement and that such relief was not made necessary, by sickness or accident, the said HENRY CADDY therefore prays that the said MARY BARTLE may be duly examined as to the place of her legal settlement and further dealt with according to Law.

The examination of HENRY ELLERY residing in the parish of Saint Clement in the County of Cornwall touching the place of the last legal settlement of MARY BARTLE Widow of JAMES BARTLE and JOHN, ELIZA and WILLIAM her children taken on oath before us EDWARD COLLINS and HENRY PRYNN ANDREW two of Her Majesty’s Justices of the Peace in and for the said County one whereof is of the Quorum at the Borough of Truro in the said County this Eighteenth day of March 1847 upon complaint of the Churchwardens and Overseers of the Poor of the parish of Saint Clement in the said County, unto us the said Justices that the said MARY BARTLE and JOHN, ELIZA and WILLIAM the said MARY BARTLE having been a widow for more than twelve calendar months have come to inhabit and are now inhabiting in the said parish of Saint Clement not having resided in the said parish for five years next before the said application and complaint and not having gained a settlement therein nor having produced any certificate acknowledging them to be settled elsewhere and that the said MARY BARTLE and JOHN, ELIZA and WILLIAM are now actually chargeable to the said Parish of Saint Clement but not having become chargeable in respect of relief made necessary by sickness of accident.

Who Saith that he is one of the Relieving Officers of the said Truro Union in the County of Cornwall and that the parish of Saint Clement in the said County is within the District of that Union for which Deponent acts as Relieving Officer from the year One thousand eight hundred and thirty seven and that from about the month of June One thousand eight hundred and forty five to about the month of September One thousand eight hundred and forty six Deponent relieved MARY BARTLE the pauper now present and who then resided in said parish of Saint Clement with one shilling weekly that such Relief was given by the order of the Board of Guardians of the Truro Union aforesaid on account of the parish of Budock which is situate within and forms part of the Falmouth Union in the said county of Cornwall

The examination of THOMAS SMEALE SKINNER now residing in the Town of Falmouth in the said County of Cornwall, touching the place of the last legal settlement of MARY BARTLE Widow of JAMES BARTLE and JOHN, ELIZA and WILLIAM her children taken on oath before us EDWARD COLLINS and HENRY PRYNN ANDREW two of Her Majesty’s Justices of the Peace in and for the said County one whereof is of the Quorum at the Borough of Truro in the said County this Eighteenth day of March, 1847 upon complaint of the Churchwardens and Overseers of the Poor of the parish of Saint Clement in the said County, unto us the said Justices that the said MARY BARTLE and JOHN, ELIZA and WILLIAM the said MARY BARTLE having been a widow for more than twelve calendar months have come to inhabit and are now inhabiting in the said parish of Saint Clement not having resided in the said parish for five years next before the said application and complaint and not having gained a settlement therein nor having produced any certificate acknowledging them to be settled elsewhere and that the said MARY BARTLE and JOHN, ELIZA and WILLIAM are now actually chargeable to the said parish of Saint Clement but not having become chargeable in respect of relief made necessary by sickness or accident.

Who saith that he is one of the Relieving Officers of the Falmouth Union in the County of Cornwall and that the parish of Budock in the said County is within that Union and is within the District of that Union for which Deponent acts as Relieving Officer that Deponent has acted as such Relieving Officer from the year One thousand eight hundred and thirty seven that this Deponent charged the parish of Budock in the said Falmouth Union by the authority of the Board of Guardians of that Union with the Relief advanced by the Truro Union in the said County from about the month of June One thousand eight hundred and forty five to about the month of September One thousand eight hundred and forty six to MARY BARTLE who was during that period residing in the parish of Saint Clement in the said Truro Union.

The examination of MARY BARTLE, Widow now residing in the parish of Saint Clement in the said County of Cornwall, touching the place of her last legal settlement taken on oath before us EDWARD COLLINS and HENRY PRYNN ANDREW two of Her Majesty’s Justices of the Peace in and for the said County one whereof is of the Quorum at the Borough of Truro in the said County this Eighteenth day of March, 1847 upon complaint of the Churchwardens and Overseers of the Poor of the parish of Saint Clement in the said County, unto us the said Justices that the said MARY BARTLE having been a widow for more than twelve calendar months and JOHN, ELIZA and WILLIAM her Children have come to inhabit and are now inhabiting in the said parish of Saint Clement not having resided in the said parish for five years next before the said application and complaint and not having gained a settlement therein nor having produced any certificate acknowledging them to be settled elsewhere and that the said MARY BARTLE and JOHN, ELIZA and WILLIAM her said Children are now actually chargeable to the said parish of Saint Clement but not having become chargeable in respect of relief made necessary by sickness or accident.

Who Saith that she is the Widow of JAMES BARTLE late of the parish of Saint Clement in the said County deceased to whom Deponent was married at the parish church of the parish of Tempa More in Ireland about twenty eight years ago and by whom she has had several Children that three of her children by her said husband are now residing with Deponent in the said parish of Saint Clement namely JOHN aged about sixteen years ELIZA aged about seven years and WILLIAM aged about five years that her said children were all born in Lawful Wedlock and that Deponent and her said three Children are now residing in and in receipt of Relief from and actually chargeable to the said parish of Saint Clement that Deponent has not been resident in the said parish of Saint Clement for five years next before this day and that Deponent and her said three Children have not become chargeable in respect of Relief made necessary by sickness or accident. That in or about the month of December One thousand eight hundred and forty two Deponent and her said late husband and her said three children were removed by virtue of the order now produced by Mr. HENRY CADDY from the parish of Saint Clement aforesaid to the parish of Budock in the said County and that for about a year and half next preceding the month of July last Deponent was in the receipt of Relief from the Overseers of the poor of Budock aforesaid that during the said year and half Deponent was resident with her said three Children at Baynards Court in the parish of Saint Clement aforesaid in a house then belonging to WILLIAM BAYNARD of Simon Street in the parish of Kenwyn in the said County that Deponent and her said three Children have done no act to gain any settlement in their respective rights

NOTICE.

In the matter of MARY BARTLE Widow of JAMES BARTLE having been a widow for more than twelve calendar months and JOHN, ELIZA and WILLIAM her three children. Paupers.

To the Overseers of the Poor of the Parish of Budock in the County of Cornwall

We the Overseers of the Poor of the Parish of Saint Clement in the County of Cornwall, do hereby give you notice that the above named MARY BARTLE and her said three Children have become chargeable to the parish of Saint Clement aforesaid and that an Order has been duly obtained for their removal to your said Parish of Budock as the place of their last legal settlement (a copy of which Order and also a Copy of the Examination on which the same order was founded and made are herewith sent). And we do also hereby give you notice that unless you appeal against the said Order and within 21 days from the date hereof duly serve notice of such appeal the said Pauper will be removed to your said Parish of Budock in pursuance of the said order.
