Will of Elizabeth Truscott, dated 17 June 1833

IN THE NAME OF GOD AMEN This is the last will and testament of me ELIZABETH TRUSCOTT of the Borough of Bodmin in the County of Cornwall Spinster. I give and bequeath unto my niece Charlotte Harvey all that my part share and interest of and all that dwelling house and premises situate in the Fore Street of the said Borough of Bodmin now in my own occupation together with all my household furniture fixtures and articles of furniture now in and belonging to the said house together with my seat number 77 in Bodmin Church. I also give unto the said Charlotte Harvey all my part share and interest of and in all those three meadows or closes of land situated and being at Bodinell in the parish of Bodmin now in the occupation of Mr Richard Coom To hold the same unto Charlotte Harvey the executors administrators and assigns for and during all my terms estate and interest therein to and for her and their own use and benefit I give and bequeath unto my nephew Edward Truscott Liddell son of Mr John Liddell of the town of Saint Columb Printer the sum of fifty pounds to be paid to the said Edward Truscott Liddell on his attaining the age of twenty one years by my executors In trust herein after named All the rest residue and remainder of my real and personal estate of what nature or kind soever or wheresoever situate lying and being I give devise and bequeath unto Robert Bradlick Edyvane of the said Borough of Bodmin Gentleman Leonard Jarvis Boor of the same Borough Clerk and Thomas Commins of the same Borough Gentleman and the survivors and survivor of them and the heirs executors administrators and assigns of such survivors and survivor In trust that they my said trustees do and shall pay the rents issues and profits of my residue of my said Real and Personal Estate unto my sister Grace Harvey and her assigns for and during the term of her natural life and from and immediately after her decease that they my said trustees do and shall sell and dispose of all the said residue of my real and personal estate for the most monies or best price or prices that can be gotten for the same and out of the monies arising there fro do and shall pay the interest dividends and annual proceeds thereof in manner following that is to say One third part or share of such interest dividends and annual proceeds thereof unto my said niece Mary Liddell and her assigns for and during the term of her natural life and the remaining one third part thereof unto my niece Elizabeth Arthur and her assigns for and during the term of her natural life and I do hereby will and direct that in case of the death of any or either of the said nieces the share or shares of such interest dividends and annual proceeds of her or them so dying shall go to and be received by the survivors or survivor of my said nieces in equal shares and proportions during their natural lives And I do thereby further will and direct that such interests dividends and annual proceeds shall not be subject or liable to the debts control or engagements of the respective husbands of my said nieces but that the receipt or receipts of my said nieces respectively shall allow a sufficient discharge or discharges to my said Trustees and from and after the death of the survivor of my said nieces I do hereby give and bequeath the produce and residue of my said real and personal estate unto my next of kin of and in equal shares and proportions to take as tenants in common and not as joint tenants And I do hereby nominate constitute and appoint the said Robert Bradlick Edyvean Leonard Jarvis Boor and Thomas Commins EXECUTORS In trust of this my will and do will and direct that their receipt or receipts shall be a sufficient discharge or discharges to any purchaser or purchasers of the whole or any part of my real or personal estate and that they shall not be answerable for any loss of the said Trust monies or premises so as the same happen without the wilful neglect or default and that they shall and retain and reimburse to themselves all such costs and charges as they or either of them shall be put unto in the execution of this my will hereby revoking all former wills by me at any time theretofore made I declare this to be my last will and testament IN WITNESS whereof I have to this my last will and testament written on this seventeenth day of June in the year of Our lord 1833 ELIZABETH TRUSCOTT Signed sealed published and declared by the said Elizabeth Truscott as and for her last will and testament in the presence of us who in her presence at her request and in the presence of each other have subscribed our names as witnesses hereto
