Will of William Sarjeant, dated 7 June 1867

This is the last Will and Testament of me William Serjeant of Barn Park in the Borough of Bodmin in the County of Cornwall Gentleman I give and devise and bequeath unto my wife Charlotte Serjeant my seat or Pew No. 3 in the Church of Bodmin aforesaid and also the interest or divideds arising half yearly on the sum of Four Thousand three hundred and thirty four pounds nine shillings and one penny Stock now standing in the Joint names of myself and Wife or separate names or party in each in the Books of the Governor and Company of the Bank of England during her natural life and after her decease I give devise and bequeath the said seat or Pew to my son Charles Eldon Serjeant of St. Bennetts in the parish of Lanivet and his mail heir or assigns for ever Also after the decease of my said Wife I give and bequeath to my son William Pye Serjeant now in the General Post Office London One thousand three hundred and thirty four pounds nine shillings and one penny part of the aforesaid Four thousand three hundred and thirty four pounds nine shillings and one penny stock to him his heirs and assigns for ever I also give and bequeath to my son The Reverend Thomas Woolcock Serjeant (now in Australia) the remaining part of the said Stock namely Three Thousand pounds (Duty Free) to him his heirs and assigns for ever and my Will is and I also direct that my said wife shall have the use and enjoyment of all my household furniture Books Paintings Plate linen china and glass during her natural life and after her decease I give and bequeath the said Household furniture Books Paintings Plate Linen China and Glass unto my aforesaid three sons in equal shares and proportions and I also will and direct that my said wife shall be at liberty to reside during her natural life in my Dwelling house and Premises situate in Fore Street in the said Borough of Bodmin now in the occupation of Mr. Hobbs (should she wish to do so) paying unto my son Charles Eldon Serjeant the sum of Five pounds per annum rent for the same and discharging all rates taxes and out-goings whatsoever on account of the said premises By virtue and in exercise and execution of all every or any power or authority given or reserved to me in or by all every or any of the Deeds or Conveyances whereby all or any of the several lands and hereditaments next hereinafter mentioned are appointed conveyed or otherwise assured unto me or any person or persons in trust for me and also by virtue and in exercise and execution of all and every other power or authority given or limited to me in that behalf I give devise and bequeath unto my son Charles Eldon Serjeant during his natural life all that new build dwellinghouse and premises now in my occupation Barn Outhouses and appurtenances thereto belonging and all those six fields adjoining or surrounding the same formerly called Priors Barn being about twenty acres Tithe free also now in my own occupation situate in the Borough of Bodmin and also all that my freehold Dwellinghouse Yard Stable Garden and Outhouses ways paths and appurtenances whatsoever there to belonging situate in Fore Street in the said Borough of Bodmin late in my own occupation and now in the occupation of the Reverend G. H. Hobbs which were purchased by me of Mr. George Woolcock (now George Pye) and Mr. Jonathan Peter and also all those three fields called Cooksland (part of Priors Barn estate late John Harris) in the said Borough of Bodmin being about twelve acres (Tithe Free) which were purchased by me of the Trustees or Representatives of John Bassett Esquire now in my own occupation and also my two freehold fields situate in Chubbs Lane in the said Borough of Bodmin lately in the occupation of Nicholas Stevens and now of Thomas Pearse being about five acres and purchased by me of the Representatives of the late Joseph Hambly Esquire And also all those three freehold Dwellinghouses Shop Yard Garden Outhouses and appurtenances ways paths and rights whatsoever thereto belonging called Dawson Henders premises situate in Fore Street and Couches in the said Borough of Bodmin and now in the occupation of William Badgery John Cocking William Sticks Felix Coom and George Sowden
Lately purchased by me of Thomas Commins Esquire Solicitor Tohold to him the said Charles Eldon Serjeant during his natural life and after his decease I give devise and bequeath unto the eldest son then alive of my said son Charles Eldon Serjeant lawfully begotten of his body all and every the aforesaid new Dwellinghouse Barn Park six fields around the same Barn Outhouses and appurtenances thereto belong all rights ways and advantages whatsoever being about twenty acres and also all those three Fields called Cookslane part of Priors Barn Estate late John Harris being about twelve acres Tohold to him the aforesaid eldest son of Charles Eldon Serjeant lawfully begotten of his body his heirs and assigns for ever and after the decease of my son Charles Eldon Serjeant I give devise and bequeath unto his second eldest son then alive lawfully begotten of his body all that Freehold Dwelling House and Premises yard Stable Garden Rights of way and appurtenances thereto belonging in Fore Street now in the occupation of the Reverend G.H. Hobbs and also my seat or Pew No. 84 in Bodmin Church and also the two Freehold Fields in Chubb’s Lane and also the three Freehold Dwellinghouses Shop Garden Yard Outhouses Ways and paths with the appurtenances thereto belonging called Dawson Henders Premises now in the occupation of the Tenants aforesaid all in Borough of Bodmin as heretofore described to hold to him the aforesaid second eldest son lawfully begotten of his body his heirs and assigns for ever and should my son Charles Eldon Serjeant die leaving but one son lawfully begotten of his body I give devise and bequeath the said freehold lands tenements and hereditaments given to the live sons aforesaid to such only son and for default of such only son or issue to the daughter if only one and if more than one to the daughters of the said Charles Eldon Serjeant lawfully begotten of his body to share and share alike as tenants in common and not as Joint Tenants and also I give and bequeath unto my son Charles Eldon Serjeant my two Guns (double and single barrel) to him his heirs and assigns for ever I also devise and bequeath unto my said son Charles Eldon Serjeant during his natural life my seat or Pew No. 84 in Bodmin Church I also give and bequeath unto my said son Charles Eldon Serjeant all that Leasehold Tenement Dwellinghouse Gardens Courtlage and four plots of ground (being about four acres of ground) situate at Priors Barn Turnpike Gate in the borough of Bodmin now in the occupation of John Hawke and myself formerly held by James Buyers under the Mayor and Town Council of Bodmin and now held by me for all the residue and remainder of my interest therein to him his heirs and assigns for ever I give and devise unto my aforesaid son William Pye Serjeant (after the death of my wife who has a life interest) therein) All that freehold dwelling house Barn Garden Mowhay Fields or closes of land with the rights and appurtenances Thereto belonging situate at Tregorrick in the parish of St. Austell in the County of Cornwall now in the occupation of John Bray Innkeeper also All that little Meadow or Freehold Quarry spot called Earls Tenement Situate in Fore Street in the Borough of Bodmin and County aforesaid now in my occupation Tohold to him the said William Pye Serjeant his heirs and assigns forever I give devise and bequeath unto my aforesaid son The Reverend Thomas Woolcock Serjeant during his natural life all that Dwellinghouse Barn Stable Yard Outhouse Garden Mowhay premises and four fields with two roads between the same about twenty three acres of land situate at Cooksland in the said Borough of Bodmin (the freehold of which was purchased by me of the Mayor and Corporation of Bodmin) subject to the existing leases for lives thereon now in the occupation of myself and Mr. John Harris to hold to him the said Reverend Thomas Woolcock Serjeant during his natural life (duty free) and after his decease I give and bequeath the said freehold premises Dwellinghouse and every the Appurtenances rights of way and benefits whatsoever thereto belonging the aforesaid four Plots with two roads between the same about twenty three acres of land to the eldest son then alive of my said son Thomas Woolcock Serjeant lawfully begotten of his body and for default of such son to the eldest daughter of the said Thomas Woolcock Serjeant lawfully begotten of his body to hold to him his said eldest son his heirs and assigns for ever and in failure of any such son to hold to her his eldest daughter her heirs and assigns for ever I give and bequeath the sum of Fifty pounds to the British and Foreign Bible Society to be paid to the Treasurer for the time being of that Society out of my residuary personal estate by my executive or executor hereinafter named within six months of my decease all the rest residue and remainder of my Goods and Chattels Lands Leasehold and other property wheresoever situated and of whatsoever nature or description dead or alive farm stock rents and profits money in my House or in the East Cornwall Bank and all personal estate and effects whatsoever which shall remain after payment of my Just debts funeral and testamentary expenses and Legacies I give devise and bequeath unto my said wife Charlotte Serjeant and to my son Charles Eldon Serjeant both of whom I do hereby appoint Joint Executive and Executor of this my Will I also give and bequeath unto my said son Charles Eldon Serjeant the power right and authority to grant or assign such parts of the lands given to him in this my Will as he may think proper for building sites during an absolute term or for three lives at a yearly consideration of not less than two shillings per statute yard. In Witness whereof I the said William Serjeant the Testator have to this my last Will and Testament written on one sheet of paper set my hand and seal this seventh day of June in the year of our Lord one thousand eight hundred and sixty seven –
