The Will of William John/Tom? Ellery, dated 25 November 1870
 

THIS IS THE LAST WILL AND TESTAMENT of me WILLIAM JOHN ELLERY of the Borough of Bodmin in the County of Cornwall feltmonger I give devise and bequeath unto my wife Elizabeth for her life only subject to mortgage debts ALL the rents and annual income of ALL my freehold property situate at Crockwell Street in the said Borough and now in the respective occupations of myself Sergeant Major Chivers Elizabeth Werry and John Bray Also the rents and annual income for her life only of ALL my undivided moiety of and in the freehold houses gardens and premises situate in Rhind Street in the said Borough in the respective occupations of Mrs Richard Harris Mrs Thomas Harris and Mr Jago carpenter Also the rents and annual income for her life only of ALL other my real estate (if any) I give my said wife 3 years after my death the legacy of £20 to be paid out of my real and personal estate I give my said wife for her life only the annual income of my residuary funeral estate After the death of my said wife I give devise and bequeath ALL my said freehold property and all my residuary Real and personal estate unto my daughter Mary Ann her heirs executors administrators and assigns absolutely I appoint my said wife Elizabeth and my said daughter Mary Ann EXECUTORS hereof

IN HER MAJESTYS COURT OF PROBATE


BE IT KNOWN that on the 15th day of August 1873 the last Will and Testament hereunto annexed of William Tom Ellery late of the Borough of Bodmin in the County of Cornwall Feltmonger deceased who died on the 6th day of July 1873 at Bodminn aforesaid and who at the time of his death had a fixed place of abode at Bodmin aforesaid within the District of the County of Cornwall was proved and registered in the District Registry attached to her Majestys Court of Probate at Bodmin and that Administration of all and singular the personal estate and effects of the said deceased was granted by the aforesaid Court to Elizabeth Ellery widow the Relict and Mary Ann Ellery Spinster the daughter the Executrix named in the Will they having been first sworn well and faithfully to administer the same, by paying the just debts of the deceased and the legacies contained in his will and to exhibit a true and perfect inventory of all and singular the said estate and effects and to render a just and true account thereof whenever required by law so to do
