This Indenture made the twenty ninth day of September the Year of our Lord One Thousand Eight hundred and twenty four Between Robert Bradlick Edyvean of the Borough of Bodmin in the County of Cornwall Esquire of the part and William KENT of the Parish of Saint Dennis in the said County Laborer of the other part Witnesseth that the said Robert Bradlick Edyvean for and in consideration of the Yearly Rent Reservations Covenants and Agreements hereinafter contained on the part and behalf of the said William Kent his Executors Administrators and Assigns to be paid kept done and performed Hath demised leased set and to farm let and in and by these presents Doth demise lease set and to farm let unto the said William Kent All that Messuage or Dwelling House Garden and several fields or closes of Land called or known by the several names of Homer Meadow, three Corner Meadow little Plot and two DownParks situate in the village and fields of Hendra in the said Parish of Saint Dennis containing in the whole about four acres be the same more or less late in the occupation of Stephen Hore and now of the said William Kent with the appurtenances to the Dwelling House and Closes of Land belonging or appertaining and also all that one field called the Lower Dry Close late in the Occupation of Michael Keam and now of the said William Kent Excepting and always reserving out of this present grant and demise unto the said Robert Bradlick Edyvean and his Assigns and such other person or persons as shall or may hereafter for the time being be entitled to Reversion and Inheritance of the said Premises hereby or intended to be hereby demised All Timber and other Tree and Trees and Saplings And all Metals Mines and Quarries of Stone and all Clay and Marle now found or hereafter to be found in or upon the said Demised Premises with full and free liberty to dig search for and work such Mines Quarries and the Metals Minerals Ore Stone Clay and Marle therefound to cleanse dress stamp and make Merchantable on the said Premises and the same to take and carry away And to erect and occupy any building or buildings on the said Premises for all or any of the purposes aforesaid or the more proper or effectual carrying on of works as aforesaid And also Excepting all Waters and Watercourses in or upon the said premises with the liberty to convert and divert the same and to make Watercourse or Watercourses through the same at his and their Pleasure And also excepting full and free liberty to and for the said Robert Bradlick Edyvean or his assigns or such other person or persons as aforesaid and all and every person or persons authorized by him and them to fowl hunt on and over the said Premises and to view and inspect unto the same and the decays and defects thereof at any time or times during the said Term when he or they she shall think proper To have and to hold the said Dwelling House Garden Lands and Closes of Land with the appurtenances (Except before Excepted) unto the said William Kent his Executors and Administrators from the date hereof for and during and unto the full end and Term of Seven Years fully to be complete and ended He the said William Kent his Executors or Administrators Yielding and Paying therefore Yearly and every Year from henceforth for and during the said Term unto the said Robert Bradlick Edyvean and his Assigns or such other person or persons as aforesaid the Yearly Rent or sum of Ten Pounds and ten shillings of good and lawful Money of great Britain current in England by even and equal quarterly payments on the most usual feasts or days of payment of Rent in every Year (that is to say) the Twenty fifth day of December the twenty fifth day of March the twenty fourth day of June and twenty ninth day of September the first payment thereof to begin and be made on the twenty fifth day of December next ensuing the date thereof And also Yielding and Paying the further Rent of Ten Pounds of like lawful Money and aforesaid for each and every Acre and so in proportion of the said hereby or intended to be hereby demised Premises that shall be tilled or Croped contrary to any or either of the Covenants and Agreements herein contained without being so manured as herein expressed when and as often as the same shall so happen and which said further Rent it is hereby declared and agreed by and between the parties aforesaid that the same shall and lawfully may be recovered as the same shall become due by distress or otherwise as other Rent in arrear And the said Rent William Kent doth hereby for himself his Executors Administrators and Assigns and for each and every of them Covenant promise and Agree to and with the said Robert Bradlick Edyvean his Heirs and Assigns and to and with such other person of persons as aforesaid in the manner following (that is to say) That he the said William Kent his Executors or Administrators shall and will well and truly pay or cause to be paid unto the said Robert Bradlick Edyvean and his Assigns or such other person or persons as aforesaid the same Yearly Rent or sum of ten pounds and ten shillings and such and further Rent as shall become due and payable on the days and times and in the proportions herebefore limited and appointed for payment of the same respectively And also shall and will pay free and discharge all the Land Tax and all the other Rates Taxes Tithes Outgoings Offices and Burthens of whatsoever kind or nature to be paid freed borne and discharged for or in respect of the said Demised Premises during the said Term And also shall and will keep in good complete order repair and Condition all the Hedges Ditches Gates Posts Bars Stiles and fences of or belonging to the said Demised Premises during the said Term and in the end or sooner determination thereof the same in such good and complete order repair and Condition shall and will leave and Yield up And also shall and will carry or cause to be carried into and upon the first breach of each and every Acre of the said Demised Premises before the same shall be put into Tillage One hundred Winchester Bushels of good well burnt stone Lime or five Cart Loads of good Salt Sea Sand and thirty Common Cart or Butt loads of good shale stable or town Dung in every Acre and so in proportion for less than an acre and will mix the same with Earth and spread and cast abroad the same according to the rules of good Husbandry And in case any Potatoes be tilled in or upon the said Premises shall and will carry or cause to be carried mixed and spread on with or before such Tillage of potatoes on the Land which shall be so tilled therewith Twenty Common Cart loads of such good Dung as aforesaid over and above what is hereinbefore mentioned And shall not nor will take but two Crops of Corn or Grain and one green Vegetable Crop after the Land shall be broken up from Grass or Ley the last which said crops shall always be Barley or Oats with the spring Tillage thereof shall and will sow Eight Pounds of good Clover Seeds and Eight gallons of good Eaver Grass seeds in each and every acre and so in proportion for less quantity than an Acre and Harrow and Roll in the same according to the Rules of good Husbandry And shall not nor will take or suffer to be taken more than one Crop of Clover or Grass from the said Devised Premises or any part thereof without first carrying and properly spreading on the Land from which such Crop shall be subsequently taken Twenty five Common Cart or Butt Loads of good Dung of such quality aforesaid in every Acre and so in proportion And shall not nor will break up the whole or any part of the said hereby or intended to be hereby demised Premises for the tillage before the same hath been out of Tillage at least three Years next preceding Nor shall or will Cut any Wood from off any of the Hedges of or belonging to the said Premises but at the proper season of the Year for so doing and when the Field or Fields adjoining shall be in Tillage with the first Crop and then shall immediately after any Cutting raise splaish double dyke and now make such Hedge and hedges according to the custom of the Country And rules of good Husbandry And shall not nor will set let Assign transfer or depart with the Possession of the said Demised Premises or any part thereof for or during the said Term or any part thereof without the leave and license of the said Robert Bradlick Edyvean or his Assigns or such other person or persons as aforesaid in writing for that purpose first had and obtained Nor shall or will do or commit or suffer to be done or committed any Waste spoil bad husbandry or destruction on the said Demised Premises or any part thereof Nor shall or will carry or suffer to be Carried off from the said Demised Premises during the said Term any Straw or Corn in the Straw Hay Compost or Manure Provided Always and upon Condition nevertheless that if the said Yearly Rent or Sum of Ten Pounds and ten shillings above observed or such further or other Rent as aforesaid shall be behind and unpaid in part or in all by the space of twenty days next after any or either of the days or times hereby mentioned for payments thereof respectively being lawfully demanded and then not paid Or of the said William Kent his Executors Administrators or Assigns shall not in all things abide by and perform all and every of the Covenants Conditions and Agreements herebefore on his and their part and behalf contained That Then for either or both the causes aforesaid it shall and may be lawful to and for the said Robert Bradlick Edyvean or his Assigns or such other person or persons as aforesaid into and upon the said Demised Premises or into any part thereof in the name of the whole to re-enter and the same to have again repossess and enjoy as his and their first and former Estate any thing herein contained to the contrary thereof in anywise Not withstanding In Witness whereof the parties aforesaid to these presents their Hands and Seals have set the day and Year first above Written
