The Will of Margarett(e) Tonkyn, dated 9 March 1692

Margarette Tonkyn

In the Name of God Amen The nynth daye
of March Anno Dni 1692 I Margarett Tonkyn of
St. Blazy in the County of Cornwall spinster being weake in
body but of perfect mind & memory praised bee God doe
make & ordayne my last Will & Testament in manner & forme
following First I resigne my Soule into the hands of Almighty
God my Maker & comitt my body to Christian buriall, Item
I give & bequeath unto my two Neeces Jane & Katherine
the Daughters of my brother John Tonkin Four pounds
to bee equally divided between my said Neeces & to bee
payd them att some convenient tyme after my death by my
Executrix hereafter named Item I give devise & bequeath
unto my ………. Mother Katherine Tonkyn widow All those
my howsehold goods now or late in the custody or possession
of Mr. Abraham Davy of St. Blazy aforesaid (That is to say)
One Beddtick, twelve Cloame platters, twelve earthen plates, One
round Table & Frame, One Feather Boulster, Eighteene
wooden plates, One payre of Curtaynes & wollens, & five drinking
glasses & four Juggs & two pewter Dishes, Item Whereas there
was a marriage formerly intended between the said Abraham Davy &
mee but never Solemnized, And certain Articles of Agreemt were
drawn relating to such intended marriage & thereby my said Mother
in consideracon of the said intended marriage did agree to pay unto the
said Abraham Davy One hundred pounds att several dayes then to come
which money at or since the Execucon of the said Articles the said
Abraham Davy did & hath many tymes declared should bee disposed
off as I should thinke fitt, And Whereas the said Abraham Davy is
justly indebted to mee in twenty pounds sixteen shillings & six pence or
thereabt I doe hereby release him of & from the same And doe give
him nyne pounds three shillings & seaven pence to bee payd him six
months after my death, Soe as in the meane tyme he execute A
sufficient Release in the Law unto my said mother & brother John Tonkin
& unto each of them of all sume or sumes of money bills bonds Covenants
Articles & writings obligatory which agt them or either of them that the
said Abraham Davy now hath or he or his Exers or Adms shall or
may claime or demand for or in Relacon to the said ………. once
intended marriage by virtue of the before menconed Articles of Agreemt
or any Obligacon or writing Obligatory given in pursuance of them
& alsoe deliver such Release unto my said mother & brother within
the said six months after my Decease, But in case the said
Abraham Davy shall refuse or neglect to execute & deliver
such Release unto my said Mother & brother & unto each of
Them Then my Will & meaneing is that the said Legacy of nyne
pounds three shillings & seaven pence shall never bee payd
the said Abraham Davy but redound & bee to & for the benefitt
of my Executrix hereafter named, And that the said debt of
twenty pounds sixteen shillings & five pence is not hereby released
unto the said Abraham Davy but shall bee lawfull for my Exrx
to implead recover & receive the same from the said Abraham
Davy, And I doe declare that itt is my Will & meaneing that
the said Abraham Davy shall have noe benefitt or advantage
agt my said Mother & brother or either of them their or either of
their Exers or Adms by virtue the said Articles of Agreemt
or of any Obligacon given by them or either of them in pursuance
thereof or any way relateing to the said once intended marriage
but the said money my Mother did by such Articles agree to
pay shall bee to & for her onely use & benefitt, in regard
the said marriage never took effect, Item I hereby give
& bequeath unto my said Mother twenty pounds, And
all the rest of my goods & Chattells rights & Creditts not
herein before given or bequeathed I doe hereby give
devise & bequeath unto my brothers William & Peter & my
Sisters Charity Elizabeth & Jane to bee equally divided
between them (my Funeral Expences beeing first
discharged) And of this my last Will & Testament doe hereby
nominate & appoint my said Mother my whole &
sole Executrix & hereby revoaking all former Wills by mee
att any tyme made either by word or in writing, In
Witness whereof I have signed & sealed these prsents
the second side or leafe of the paper & the same published
& declared to bee my last Will & Testamt this said 9th
day of March Anno Dni 1692
