1829 16th September Advent

THIS INDENTURE MADE the 16th day of September in the year of Our Lord 1829 BETWEEN WILLIAM BURT the older of Higher Town within the Parish of Advent in the County of Cornwall yeoman of the one part and THOMAS JORY of the said Parish yeoman of the other part WHEREAS in and by a certain Indenture of Assignment by way of mortgage bearing date the 25th day of March 1824 and made between the said Thomas Jory of the one part and the said William Burt of the other part the closes and parcels of land commonly called or known by the name of HIGHER BEEF PARKS in Widewalls situate in the Parish of Advent therein and hereinafter particularly mentioned and described were assigned and set over unto the said William Burt his executors administrators and assigns for and during the time and term of 1000 years to commence from the day next before the date thereof for securing the repayment of £90 at that time lent and advanced by the said William Burt to the said Thomas Jory as therein mentioned and the interest to grow due for the same as by the said Indenture reference being thereunto had will more fully appear AND WHEREAS the said Thomas Jory having on the day of the date hereof paid off and discharged the said principal money and the interest thereof due and owing as aforesaid to the said William Burt amounting to the sum of £96 hath called on the said William Burt to assign the same premises unto him the said Thomas Jory his executors administrators and assigns in order that the residue of the said term of 1000 years may merge in the freehold and larger estate of the said Thomas Jory of and in the said hereditaments which he hath considered and agreed to do NOW THIS INDENTURE WITNESSETH THAT IN PURSUANCE OF THE SAID Agreement and in consideration of the said sum of £90 so said as aforesaid and also in consideration of the term of 10/- by the said Thomas Jory to the said William Burt in hand well and truly paid at and before the sealing and delivery of these presents DOTH bargain sell assign transfer and set over unto the said Thomas Jory his executors administrators and assigns ALL THOSE Closes and parcels of Land commonly called or known by the name of HIGHER BEEF PARKS in Widewalls situate lying and being in the said Parish of Advent otherwise Saint Jane late in the possession of Philip Brown but now of him the said Thomas Jory Together with all houses outhouses buildings barns stables yards gardens orchards pastures feedings woods underwoods ways paths water watercourses easements profits commodities advantages hereditaments and appurtenances whatsoever to the same belonging incident or in anywise appertaining AND the Reversion and Reversions Remainder and Remainders rents dues duties suits services issues and profits thereof and of every part thereof AND all the estates right tile interest term and term of years yet to come and unexpired property possession claim and demand whatsoever both at Law and Equity or otherwise howsoever of him the said William Burt of in and to the same or any part thereof TO HAVE AND TO HOLD the said Closes and parcels of Land hereditaments and premises hereby assigned or intended so to be with their and every of their appurtenances unto the said Thomas Jory his executors administrators and assigns for and during all the rest residue and remainder of the said term of 1000 years now to come and unexpired therein TO THE INTENT that the same term may merge and be sunk in the freehold or larger estate of the said Thomas Jory of and in the said Closes and parcels of Land hereditaments and premises respectively AND the said William Burt doth hereby for himself his executors administrators covenant declare and agree to and with the said Thomas Jory his executors administrators and assigns that he the said William Burt hath not at any time heretofore done made committed or knowingly suffered or cause or procured to be done made committed executed or suffered nor been party or privy to any act deed matter or thing whatsoever hereby or by means whereof the said Closes and parcels of Land hereditaments and premises hereby assigned and assured or intended so to be or any part or parcel thereof with the appurtenance or the term and interest mentioned and intended to be hereby assigned therein is are or can or may be impeached charged incumbered or prejudicially affected in title charge estate or otherwise howsoever IN WITNESS whereof the parties aforesaid to these presents their hands and seals INTERCHANGEABLY have set the day and year first above written
